Enforcement Procedure

a) Where a tenant fails to follow the terms of their tenancy agreement or any of the rules stated in these rules the council will serve the relevant notice on the tenant to which the tenant must respond within the time limits as set out within this clause.

b) Instant improvement Notice 

  • This notice will be issued by the Allotment Officer from the council.
  • The tenant will have to respond and comply with the notice immediately.
  • Failure to comply with this notice will result in a one-month Tenancy Termination Notice being served.

c) 28 Day Improvement Notice

  • This notice will be issued by an Allotment Officer from the council.
  • The Tenant will have 28 days starting from the date shown on the notice to respond and comply with the notice served.
  • Failure to comply will result in a one-month tenancy Termination Notice being served.

d) One-month Tenancy Termination Notice

  • This notice will be issued by the appropriate director of the council or other appropriate officer if the Tenant fails to comply with any previous notice that has been served.
  • Or if any tenant is found to have grossly breached their Tenancy Agreement or the rules.
  • The tenant will have 10 working days from the date of receipt of the Tenancy Termination Notice to appeal the decision. Any appeal must be supported by a statement of case to the appropriate director of the council via the Allotment Officers which will be reviewed as part of the decision -making process to terminate the tenancy. The Directors decision shall be final.
