Have your say: Single use vape regulations

We want your feedback on our approach to enforcing the Environmental Protection (Single use Vapes) (England) Regulations 2024. These new rules aim to tackle the environmental impact of single use vapes.

As the local regulator, we're required to publish guidance on how we'll use penalties, notices, and other sanctions outlined in the regulations. This document explains:

  • What the new regulations mean for the supply of single use vapes (which must now be refillable and rechargeable).
  • The potential penalties for businesses that break the law, including fines and legal action.
  • How we will use different types of notices, such as Fixed Penalty Notices and Compliance Notices.
  • Your rights to make representations, object to notices, and appeal decisions.
  • How we may use stop notices to immediately halt harmful activities.
  • Information about enforcement undertakings and how businesses can offer to put things right.
  • How we may recover costs when businesses fail to comply with notices.
