Article 4 Directions and Conservation Areas

Information about Permitted Development Rights and Article 4 directions

Permitted development rights allow householders to improve and extend their homes without the need to apply for planning permission where that would be out of proportion with the impact of works carried out. An Article 4 Direction allows the council to remove certain permitted development rights in a particular area. Provisions within the Article 4 Direction may relate to the conservation area as a whole or an individual home(s) within the conservation area where there are historical or architectural features the we want to protect. These changes mean you will need to ask our permission before doing certain improvements or extensions to your home in these areas.

REMOVAL OF THE BELOW ARTICLE 4 DIRECTION

 

1. No part of any building within a Conservation Area shall be treated with any form of cement rendering or stonework cladding including imitation stonework cladding without the prior consent of the local planning authority.

2. No painting or repainting of external brickwork of any building within a Conservation Area shall occur without the prior consent of the local planning authority.

Key

 

Part 1 – Development within the curtilage of a dwellinghouse

Class A: The enlargement, improvement or other alteration of a dwellinghouse where any part of the enlargement improvement or other alteration would front a relevant location,

Class B: The enlargement of a dwellinghouse consisting of an addition or alteration to its roof which would front a relevant location.

Class C: Any other alteration to the roof of a dwellinghouse where the alteration would be to a roof slope which fronts a relevant location.

Class D: The erection or construction of a porch outside any external door of a dwellinghouse where the external door fronts a relevant location.

Class F: Development consisting of;

  1. the provision within the curtilage of a dwellinghouse of a hard surface for any purpose incidental to the enjoyment of the dwelling house as such, where the hard surface would front a relevant location: or
  2.  the replacement in whole or in part of such a surface where the hard surface would front a relevant location.

Class G: The installation, alteration or replacement of a chimney, on a dwellinghouse.

Part 2 – Minor Operations

Class A: The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure which fronts a relevant location (‘fronts the waterway’ in the case of Caldon Canal Conservation Area 2022 and Trent and Mersey Canal Conservation Area 2022).

Class C: The painting of the exterior of any building or work where the part of the exterior to be painted would front a *relevant location (in the case of Caldon Canal Conservation Area 2022 and Trent and Mersey Conservation Area 2022) OR (in the case of Penkhull Village Conservation Area 2022 and Albert Square Conservation Area 2024, a highway) including hitherto unpainted parts of the elevation, or with the exception of these specific conditions:

  1. The repainting of an existing painted surface is painted with a colour to match the existing one in every respect of colour, hue, texture and appearance.
  2. The repainting of an existed painted surface is painted with a colour shown in following list of British Standard References for paint: (list specified on each Direction).

Part 11 – Heritage and Demolition

Class C: Any building operation consisting of the demolition of the whole or any part of any gate, fence, wall or other means of enclosure and fronts a relevant location (‘fronts the waterway’ in the case of either Caldon Canal Conservation Area 2022 and Trent and Mersey Canal Conservation Area 2022).

NB: * “relevant location” means a highway, waterway or open space.
