Managing the Public Rights of Way

Add or Amending a Public Right of Way

To add or amend a Public Right of Way (PROW) to the Definitive Map and Statement, this can only be done by legal order. Before applying, complete the following checks to see if the PROW has already been considered:

  • Check the Definitive Map (link) – this is to see if the PROW is already present
  • Check the Register of Applications (link) – this is to see if an application for the location is already in progress
  • Check the Section 31 Deposits (link) – this is to check if a landowner has protected their land

Strong evidence will be required to support the application, which could include historical information such as maps or title plans, or evidence that a route has been used uninterrupted for more than 20 years.

Temporary Closures

The Council has the power to temporarily restrict or prohibit the use of a Public Right of Way under the Road Traffic Regulation Act 1984. Landowners or people undertaking works in the vicinity of a Public Right of Way, such as Utility Companies or contractors, can apply to the Council for a temporary closure. Please note that temporary closure periods may differ for roads and footways.

When applying for a closure, the following conditions apply in all circumstances:

  • The reason for the closure must be disclosed
  • An alternative route must be provided and signed. This route must be in a good state of repair, and be a minimum of 2m wide for a footpath or 3m wide for a bridleway/byway
  • A notice of the closure must be erected at each end of the section a minimum of 7 days prior to the closure.
  • A replacement closure notice must be erected at each end of the proposed section when the closure period is effective
  • All surfaces must be made good immediately after the closure period. The Council will seek to recover costs for making good any surfaces not remediated within 7 days.
  • Private access must be retained at all times where applicable. You are responsible for making arrangements with affected parties
