How we use your data

We keep this information is to meet the obligations placed on us by two pieces of government legislation:

  • Self Build and Custom Housebuilding Act of 2015
  • Housing and Planning act 2016.

These require councils to hold a register of individuals and associations who wish to express their interest in resident self-build and custom house-building in their respective areas.

This allows us to determine the overall level of demand for self-build and custom-build houses in our area.

We need a variety of information from each applicant to enter on our register.

As part of our obligations in connection with the register, we may need to contact you from time to time, so we will need information relating about you, including your name and contact details.

In order for us to monitor trends in the data, we may also ask for information about applicants’ preferences and their specific property or plot requirements.

The data will be kept on the council’s IT infrastructure and only accessible to staff who need it to process your requests. The council takes information security very seriously and has a number of policies, procedures and processes to ensure the confidentiality, integrity and availability of all information we hold.

When we are legally obliged to do so, we may need to share information on the register with other Government agencies for fraud prevention purposes.

We may share data with our internal audit team to evaluate the effectiveness of the council's risk management, control and governance processes.  

We may also share your data with our corporate fraud team for the prevention and detection of fraud.

We may share the information on the register with other departments within the city council to monitor and analyse the data as appropriate, in these circumstances the data will be anonymised.

We will not be transferring the data outside the EEA?

The length of time we will keep the information will depend on whether the applicant is eligible to join the register or not.

  • not eligible: archive period will be one year and retention period is two years
  • eligible: archive period will be two years and retention period is seven years

We will remove personal data on request but for us to monitor trends across the register, we will retain non-person-specific data indefinitely. This information will be completely anonymised and will not be linked to any specific individual or association.

There is no automated decision making involved with the register.

Data protection law provides you with certain rights, but not all of these rights will be available to you in all situations. Where we are under a legal duty to use data for a particular purpose you will not have the right to prevent it being used in that way.

  • you can ask to see the information we hold about you
  • you can ask what is being done with the information we hold about you
  • you can ask to have some of the data we hold about you deleted
  • you can ask us to review a decision made about you by a computer, and ask for a new decision to be made by a person
  • you can ask us to stop processing the data we hold about you
  • you can ask us to make changes to data about you that you believe is inaccurate
  • in some circumstances you can ask us to help you move your information to another organisation
  • you can ask us to restrict or limit what we do with your data, for example if you believe the data we hold is inaccurate, or if you believe the processing is unlawful
